This volume provides the first English translation of Hans Kelsen's and Carl Schmitt's influential Weimar-era debate on constitutional guardianship and the legitimacy of constitutional review. It includes Kelsen's seminal piece, 'The Nature and Development of Constitutional Adjudication', as well as key extracts from the 'Guardian of the Constitution' which present Schmitt's argument against constitutional review. Also included are Kelsen's review of Schmitt's 'Guardian of the Constitution', as well as some further material by Kelsen and Schmitt on presidential dictatorship under Article 48 of the Weimar Constitution. These texts show Kelsen and Schmitt responding to one another, in the context of a debate focused on a concrete constitutional crisis, thus allowing the reader to assess the plausibility of Kelsen's and Schmitt's legal and constitutional theories..

The Law-Making Process - Michael Zander Preview:

As a critical analysis of the law-making process, this book has no equal. For more than three decades it has filled a gap in the requirements of students in law or political science taking introductory courses on the legal system and is now in its 7th edition. It deals with every aspect of the law-making process: the preparation of legislation; its passage through Parliament; statutory interpretation; binding precedent; how precedent works; law reporting; the nature of the judicial role; European Union law; and the process of law reform. It presents a large number of original texts from a variety of sources – cases, official reports, articles, books, speeches and empirical research studies – laced with the author's informed commentary and reflections on the subject. This book is a mine of information dealing with both the broad sweep of the subject and with all its detailed ramifications. "In a crowded market place Zander's latest edition of The Law-Making Process stands out like a beacon in the fog. Well chosen extracts from stimulating texts enable the neophyte student of the law making process in England and Wales to grapple with the issues of the hour with a forcefulness and insight we have long come to associate with the author. Highly recommended." Professor Alan Paterson "Law-making is important, fascinating, and fun. This new edition of Michael Zander's stimulating book on law-making brings that out. It takes account of the many developments since the 6th edition in 2004, ranging across the work of the Law Commission, parliamentary scrutiny of Bills, the relationship between our courts and the European Court of Human Rights, the EU, and many other matters. Well chosen extracts and thought-provoking commentary help law and politics students at every level to understand the raw material with which they work, and make more experienced practitioners and academics look afresh at topics we thought we understood. I recommend it highly." Professor David Feldman "As counsel, judge and now cross-bencher in the House of Lords I have been taking part in the law-making process for over fifty years. In explaining to me what I have been up to, Michael Zander both informed and amused. Not only does he deal in detail with every aspect of the law-making process, but he has assembled a rich cornucopia of commentary from a wide variety of sources. He has shown a degree of self-restraint in expressing his own views, though his use of an adverb made them pleasingly plain when he stated “On 3 October, 2014, the Conservative Party published an 8 page document, brazenly called “Protecting Human Rights in the UK”. I commend this book to anyone who wishes to understand the far from simple way that law is made in this country." Lord Phillips.

Inhaltsangabe:Abstract: This study investigates in how far the news language of weblogs differs from the news language in traditional print or online newspapers. A special focal point is set on oral language and its functions. The analysis should help to answer the questions: - Can weblogs help to minimize the distance between journalists and readers? - Can weblogs assist in attracting a new kind of readership? - Can weblogs assist in raising readership loyalty? All results can also be transferred from journalism to public relations and marketing: - Can weblogs help to provide you closer insight into your customer needs? - Can weblogs assist in attracting new target groups? - Can weblogs assist in raising customer loyalty? The study is set up according to the following sequence: Firstly, a general approach to weblogs is presented, describing their structure, development and implementation. Secondly, differences between the spoken and written mode are outlined and several models depicting the continuum relationship between both are introduced. After the explanation of the significance and function of orality in written electronic and news discourse, the concept of oral models in the press is introduce. In a last step, a sample analysis of several articles from one journalistic weblog is conducted, one online and one traditional newspaper, applying a linguistic framework based on the theoretical works presented before. With this examination, it is shown that the language used in journalistic weblogs contains more characteristics from the variety of spoken language than the languages of online and traditional print newspapers. From the results, potential effects are derived, e.g. on the practical fields of application or on the composition of the readership. Until now, only 38% of all adult US internet users and 37% of the Germans know what a weblog or short blog is. But nevertheless, weblogs have already attracted great attention from around the globe during the past nine years since their first appearance. In September 2004, Time asked Is this a media revolution? Initially, bloggers pointed their readers to interesting sites they found on their travels in the World Wide Web. Later, this filter function was used primarily to comment and criticize media coverage of news. Thus, bloggers were claimed to be the antithesis of traditional journalists: unedited, unabashedly opinionated, sporadic and personal . This personal aspect was [...].

Nearly a decade after the 2000 Presidential elections invited a firestorm of questions about the sanctity of our democratic process, there continues to be a heightened interest in the role of state-wide elections officials, typically the state's Secretary of State - this book looks into their pivotal role in the promotion of a healthy democracy. Much past interest has resulted in overly critical coverage of election errors, ignoring the tireless efforts that ensure the American citizens benefit from a democratic, inclusive and accountable election process. Through a series of case studies, anecdotes, and interviews with current and recent secretaries, State Secretaries of State author Jocelyn Benson readdresses this balance by providing the first in-depth study of the Secretary's role in registering voters, enforcing voting laws and regulations, overseeing elections, and certifying results. As such, it represents a much-needed contribution to the study of US elections, both in practice and in law..

Foreign Aid and Emerging Powers - Iain Watson Preview:

Current debates on emerging powers as foreign aid donors often fail to examine the myriad geopolitical, geoeconomic and geocultural tensions that influence policies of Official Development Assistance (ODA). This book advocates a regional geopolitical approach to explaining donor-donor relationships and provides a multidisciplinary critical assessment of the contemporary debates on emerging powers and foreign aid, bringing together economic and geopolitical approaches in the light of the 2015 completion of the Millennium Development Goals (MDGs). Moving away from established debates assessing the advantages and disadvantages of foreign aid, this book challenges the current geopolitical assumptions of the emerging powers concerning issues such as 'south-south' solidarity, shared development experience and 'multipolarity'. It analyses how donor governments 'sell' aid to recipients through enabling different cultural assumptions and soft power narratives of national identity and provides empirical evidence on agendas such as aid effectiveness, aid for trade, public-private partnerships, and green growth aid. The book examines the role of, and relationships between, the leading traditional and emerging power Asian donors specifically, and explores the different and contested perspectives and patterns of ODA policy through an alternative account of emerging power foreign aid to leading African and Asian recipients. This book provides a valuable resource for postgraduate students and practitioners across disciplines such as development economics and geopolitics of development, uniquely approaching the debate from the perspective of emerging powers and donors..
