Protecting Traditional Knowledge - Daniel F. Robinson,Ahmed Abdel-Latif,Pedro Roffe Preview:

This is the first comprehensive review of the Intergovernmental Committee (IGC) of the World Intellectual Property Organization (WIPO) established in 2000. It provides an in-depth consideration of the key thematic areas within WIPO discussions – genetic resources (GRs), traditional knowledge (TK) and traditional cultural expressions (TCEs) through the perspectives of a broad range of experts and stakeholders, including indigenous peoples and local communities. It also looks at how these areas have been treated in a number of forums and settings (including national systems and experiences, and also in trade agreements) and the interface with WIPO discussions. Furthermore, the book analyses the process and the negotiation dynamics since the IGC received a mandate from WIPO members, in 2009, to undertake formal text-based negotiations towards legal instruments for the protection of GR, TK and TCEs. While there has been some progress in these negotiations, important disagreements persist. If these are to be resolved, the adoption of these legal instruments would be a significant development towards resolving key gaps in the modern intellectual property system. In this regard, the book considers the future of the IGC and suggests options which could contribute towards achieving a consensual outcome..

Since the terrorist attacks of September 11, 2001, there has been much discussion of the security of borders and ports of entry in the United States and around the world. Ports of entry, particularly sea ports, are viewed as one of the most defenceless targets for a terrorist attack. In response to this perceived vulnerability, a number of port security initiatives have been implemented both on both a domestic and international level. This timely project investigates a number of issues surrounding the container security issue. It examines the scope of containerized freight security, analyzes cooperation between agents in the United States and abroad, explores the politics of port security, and provides an assessment of 17 of the world's sea ports. The work sheds light on the container security threat and the domestic and international responses that have emerged, as well as those steps that still must be taken..

Reducing Poverty, Protecting Livelihoods, and Building Assets in a Changing Climate - Dorte Verner Preview:

Climate change is the defining development challenge of our time. More than a global environmental issue, climate change and variability threaten to reverse recent progress in poverty reduction and economic growth. Both now and over the long run, climate change and variability threatens human and social development by restricting the fulfillment of human potential and by disempowering people and communities in reducing their livelihoods options. Communities across Latin America and the Caribbean are already experiencing adverse consequences from climate change and variability. Precipitation has increased in the southeastern part of South America, and now often comes in the form of sudden deluges, leading to flooding and soil erosion that endanger people s lives and livelihoods. Southwestern parts of South America and western Central America are seeing a decrease in precipitation and an increase in droughts. Increasing heat and drought in Northeast Brazil threaten the livelihoods of already-marginal smallholders, and may turn parts of the eastern Amazon rainforest into savannah. The Andean inter-tropical glaciers are shrinking and expected to disappear altogether within the next 20-40 years, with significant consequences for water availability. These environmental changes will impact local livelihoods in unprecedented ways. Poverty, inequality, water access, health, and migration are and will be measurably affected by climate change. Using an innovative research methodology, this study finds quantitative evidence of large variations in impacts across regions. Many already poor regions are becoming poorer; traditional livelihoods are being challenged in unprecedented ways; water scarcity is increasing, particularly in poor arid areas; human health is deteriorating; and climate-induced migration is already taking place and may increase. Successfully reducing social vulnerability to climate change and variability requires action and commitment at multiple levels. This volume offers key operational recommendations at the government, community, and household levels with particular emphasis placed on enhancing good governance and technical capacity in the public sector, building social capital in local communities, and protecting the asset base of poor households..

Protecting Children Online? - Tijana Milosevic Preview:

A critical examination of efforts by social media companies—including Facebook, Twitter, Snapchat, and Instagram—to rein in cyberbullying by young users. High-profile cyberbullying cases often trigger exaggerated public concern about children's use of social media. Large companies like Facebook respond by pointing to their existing anti-bullying mechanisms or coordinate with nongovernmental organizations to organize anti-cyberbullying efforts. Do these attempts at self-regulation work? In this book, Tijana Milosevic examines the effectiveness of efforts by social media companies—including Facebook, Twitter, YouTube, Snapchat, and Instagram—to rein in cyberbullying by young users. Milosevic analyzes the anti-bullying policies of fourteen major social media companies, as recorded in companies' corporate documents, draws on interviews with company representatives and e-safety experts, and details the roles of nongovernmental organizations examining their ability to provide critical independent advice. She draws attention to lack of transparency in how companies handle bullying cases, emphasizing the need for a continuous independent evaluation of effectiveness of companies' mechanisms, especially from children's perspective. Milosevic argues that cyberbullying should be viewed in the context of children's rights and as part of the larger social problem of the culture of humiliation. Milosevic looks into five digital bullying cases related to suicides, examining the pressures on the social media companies involved, the nature of the public discussion, and subsequent government regulation that did not necessarily address the problem in a way that benefits children. She emphasizes the need not only for protection but also for participation and empowerment—for finding a way to protect the vulnerable while ensuring the child's right to participate in digital spaces..

The Responsibility to Protect (R2P) is intended to provide an effective framework for responding to crimes of genocide, ethnic cleansing, war crimes, and crimes against humanity. It is a response to the many conscious-shocking cases where atrocities - on the worst scale - have occurred even during the post 1945 period when the United Nations was built to save us all from the scourge of genocide. The R2P concept accords to sovereign states and international institutions a responsibility to assist peoples who are at risk - or experiencing - the worst atrocities. R2P maintains that collective action should be taken by members of the United Nations to prevent or halt such gross violations of basic human rights. This Handbook, containing contributions from leading theorists, and practitioners (including former foreign ministers and special advisors), examines the progress that has been made in the last 10 years; it also looks forward to likely developments in the next decade..

Protecting the U.S. Population’s Health Against Potential Economic Recessions and High Unemployment and the Endemic Inflation of Health Care Costs - Fritz Dufour Preview:

This book has three main parts: (1) the challenges of the U.S. health care system; (2) the impacts of economic recessions and high unemployment on the U.S. population’s health; and (3) recommendations or a look into what might improve the health care system. Part I, through a dissection of the challenges faced by the U.S. health care system, exposes the particularities and the vulnerabilities of the system. It shows the role played by businesses and employment in the U.S. population’s health and describes major challenges of the health care system such as astronomical health care costs, the average family health spending – which is exceedingly high, wasteful spending, death due to inaccessibility to health care, and the hardships that medical costs created for more than half of Americans. Part II is an analysis as to why do economic recessions have health implications. That analysis is done by considering the health implications of economic recessions both at the micro and macroeconomic levels and by considering the societal costs of uninsurance or inaccessibility to health care due to economic recessions and high unemployment. Part III primarily focuses on what can make the system better, that is more efficient and more cost-effective. Ironically, as Part III argues, there are a myriad of feasible recommendations that are waiting to be fully explored, agreed upon, adopted and implemented nationwide: · Design labor and fiscal policies aimed at preventing economic recessions and high unemployment o Blend labor and fiscal policies into structural reforms · Create job security and take other steps that guarantee health care security during financial hardship · Improve health outcomes through nationwide permanent supportive housing to combat chronic homelessness during economic recessions and high unemployment · Prioritize the use of more cost-effective medical technologies o Promote telemedicine to reduce costs and improve accessibility to health care · Eliminate health disparities thanks to the democratization of health care · Promote health literacy and the valorization of communities · Design policies or procedures that 1) promote health care costs reduction and efficiency through affordable insurance coverage and 2) eliminate Wasteful spending: o Extend drug coverage and implement cost-effective pricing policies o Extend coverage of more medical procedures and implement cost-effective policies On the other hand, Part III also sells the idea of a thorough and bold revolution in our health care system, which would make health care a right of citizenship. It does so by analyzing the political, social, ethical, and economic aspects of the issue. Furthermore, it argues that the relationship between universal health care and economics justifies the notion of “health care as a right of citizenship.”.

Protecting Civilians During Violent Conflict - Igor Primoratz Preview:

There is almost unanimous agreement that civilians should be protected from the direct effects of violent conflict, and that the distinction between combatant and non-combatant should be respected. But what are the fundamental ethical questions about civilian immunity? Are new styles of conflict making this distinction redundant? Eloquently combining theory and practice, leading scholars from the fields of political science, law and philosophy have been brought together to provide an essential overview of some of the major ethical, legal and political issues with regard to protecting civilians caught up in modern inter- and intra-state conflicts. In doing so, they examine what is being done, and what can be done, to make soldiers more aware of their responsibilities in this area under international law and the ethics of war, and more able to respond appropriately to the challenges that will confront them in the field. 'Protecting Civilians During Violent Conflict' presents a clear-eyed look at the dilemmas facing regular combatants as they confront enemies in the modern battlespace, and especially the complications arising from the new styles of conflict where enemy and civilian populations merge..

Protecting Human Rights Defenders at Risk - Alice M. Nah Preview:

This book assesses the construction, operation and effects of the international protection regime for human rights defenders, which has evolved significantly over the last twenty years in response to the risks people face as they promote and protect human rights. Drawing upon the experiences of human rights defenders who continue to persevere in their activism in Indonesia, Egypt, Kenya, Mexico and Colombia, this edited collection examines the ways in which formal protection mechanisms by state and civil society actors intersect with self-protection measures and informal protection initiatives by families and friends. It highlights that protection practices are most effective when they are designed to address the specific risks that human rights defenders face (which are gendered and intersectional); reflect how defenders understand ‘risk’, ‘security’ and ‘protection’; and are appropriate for the dynamic socio-political and legal contexts in which defenders operate. This book proposes ways in which the protection of human rights defenders at risk should be reimagined and practised. This book will be a though-provoking guide for students and scholars of politics, international relations, law and human rights, as well as to practitioners engaged in the protection of human rights defenders at risk..

Protecting Biological Diversity - Carmen Richerzhagen Preview:

During the last ten years the enormous global loss of biodiversity has received remarkable attention. Among the numerous approaches undertaken to stop or lessen this process, access and benefit-sharing (ABS), a market-based approach, has emerged as among the most prominent. In theory, ABS turns biodiversity and genetic resources from an open access good to a private good and creates a market for genetic resources. It internalizes the resources’ positive externalities by pricing the commercial values for research and development and makes users pay for it. Users’ benefits are shared with the resource holders and set incentives for the sustainable use and the conservation of biodiversity. Carmen Richerzhagen, however, finds that in practice there are significant questions about the effectiveness of the approach in the protection of biodiversity and about the fair and equitable sharing of benefits arising from the commercialization. Utilizing the empirical findings of three case studies of biodiversity-providing countries - Costa Rica, the Philippines and Ethiopia - and one case study of a community of user countries, the European Union (EU), Richerzhagen examines the effectiveness of ABS through the realization of its own objectives..

Routledge Handbook of Environmental Conflict and Peacebuilding - Ashok Swain,Joakim Öjendal Preview:

The past two decades have witnessed the emergence of a large body of research examining the linkage between environmental scarcity, violent conflict, and cooperation. However, this environmental security polemic is still trying to deliver a well-defined approach to achieving peace. Studies are being undertaken to find the precise pathways by which cooperative actions are expected not only to pre-empt or moderate resource conflicts but also to help diffuse cooperative behaviour to other disputed issues. The recognition that environmental resources can contribute to violent conflict accentuates their potential significance as pathways for cooperation and the consolidation of peace in post-conflict societies. Conceived as a single and reliable reference source which will be a vital resource for students, researchers, and policy makers alike, the Routledge Handbook of Environmental Conflict and Peacebuilding presents a wide range of chapters written by key thinkers in the field, organised into four key parts: Part I: Review of the concept and theories; Part II: Review of thematic approaches (resources, scarcity, intervention, adaptation, and peacebuilding); Part III: Case studies (Middle East, Iraq, Jordan, Liberia, Nepal, Colombia, Philippines); Part IV: Analytical challenges and future-oriented perspectives. Enabling the reader to find a concise expert review on topics that are most likely to arise in the course of conducting research or policy making, this volume presents a truly global overview of the key issues and debates in environmental conflict and peacebuilding..

Protecting the Homeland 2006/2007 - Michael d'Arcy,Michael E. O'Hanlon,Peter R. Orszag,Jeremy Shapiro,James B. Steinberg Preview:

Immediately after September 11, the Brookings Institution began a comprehensive, multidisciplinary project focused on the key policy challenge of these dangerous times—assessing and improving homeland defense. That intense effort produced Protecting the American Homeland, and it continues in this important new book. In Protecting the Homeland 2006/2007, Brookings foreign policy experts analyze current homeland security concerns and the adequacy (or inadequacy) of current policies designed to address them. The authors present both the big picture and the smaller components of homeland security policy that make up the whole. They make specific recommendations on intelligence reform, science and technology policy and the protection of critical infrastructure within the United States. They also look ahead to consider what dangers we should anticipate and plan for, recommending policies that will work to that end. One of the strands running through Protecting the Homeland 2006/2007 is the need to "stitch the seams" in our homeland security blanket through greater integration and coordination. The authors emphasize that the U.S. federal government must work together with key partners who have been insufficiently integrated into American homeland security activities to date. These actors include foreign governments, state and local government, and the private sector, and the coordination must occur in several different areas (e.g. border protection, finance, technology, intelligence). The U.S. government should not—indeed, it cannot—do it alone. By its very nature, homeland security is a problem that defies the usual bureaucratic boundaries. Effective homeland security policy demands intense collaboration on new issues and between organizations that have not traditionally needed each other. This book is of interest and importance to journalists, analysts, policymakers, scholars, and citizens concerned with protecting their homeland against terrorism and related dangers..

Mass Atrocities, the Responsibility to Protect and the Future of Human Rights - Simon Adams Preview:

This book ambitiously weaves together history and politics to explain all of the major situations where mass atrocities have occurred, or been prevented, over the 15 years since the 'Responsibility to Protect' (R2P) was adopted at the 2005 UN World Summit. The author provides a history of human rights, mass atrocities and the principle of the R2P from the perspective of someone whose day job has been to work with the UN Security Council, various governments and civil society to help ensure the international community does not fail those who face the threat of genocide, war crimes and crimes against humanity today. It examines the implementation of the controversial principle of R2P since 2011 and how we end the politics of impunity, indifference and inaction once and for all. Using case studies from Iraq, Syria, Myanmar and Libya, the book offers a unique perspective regarding how we make 'never again' a living principle, rather than a cliché and how we end the politics of impunity, indifference and inaction once and for all. It will be of especial interest to scholars, students and policymakers working in the fields of international politics or concerned about human rights, atrocities, the United Nations and international justice in the world today..
