Intellectual Property and Biotechnology - Matthew Rimmer Preview:

Dr Rimmer s book is a marvellous introduction to a crucial topic of our time. He writes engagingly, provocatively and always with good humour. A highly technical and complex area of law has been reduced to clear descriptions and searching analysis. Truly, this is an important book on an essential topic that will help define the ethics of a future that includes nothing less than the future of our species. From the foreword by the Hon Justice Michael Kirby AC CMG, the High Court of Australia . . . the author has done an excellent job by explaining the subject in an open and accessible manner. This book is a timely and very thought-provoking analysis of patent law and biotechnology. . . The book is a unique theoretical contribution to the controversial public debate over commercialization of biological inventions. . . there is an extensive bibliography. . . a valuable resource for further reading. The book will be of prime interest to lawyers and patent attorneys, scientists and researchers, business managers and technology transfer specialists. Journal of Intellectual Property Rights Rimmer s book is highly recommended for anyone interested in the issues and debate related to biological inventions, regardless of which side the reader is on. Stefan M. Miller, Journal of Commercial Biotechnology . . . this book gives an excellent account of the most celebrated biotechnology cases from three continents, and for this alone is to be thoroughly recommended. David Rogers, European Intellectual Property Review Rimmer has put a great deal of thought and effort into this series of chapters. For those looking at how to reform, direct and develop laws in relation to biotechnology, this book is brimming with ideas, suggestions and recommendations of what to do next. Rebecca Halford-Harrison, Chartered Institute of Patent Attorneys . . . an excellent introduction to a wide range of legal thinking in an increasingly controversial and relevant area to humankind. Sharon Givoni, Australian Intellectual Property Law Bulletin Rimmer s new book is a timely and very thought-provoking analysis of patent law and biotechnology and asks a very serious question: can a 19th century patent system adequately deal with a 21st century industry? Kate McDonald, Australian Life Scientist This book documents and evaluates the dramatic expansion of intellectual property law to accommodate various forms of biotechnology from micro-organisms, plants, and animals to human genes and stem cells. It makes a unique theoretical contribution to the controversial public debate over the commercialization of biological inventions. The author also considers the contradictions between the Supreme Court of Canada rulings in respect of the Harvard oncomouse, and genetically modified canola. He explores law, policy, and practice in both Australia and New Zealand in respect to gene patents and non-coding DNA. This study charts the rebellion against the European Union Biotechnology Directive particularly in respect of Myriad Genetics BRCA1 and BRCA2 patents, and stem cell patent applications. The book also considers whether patent law will accommodate frontier technologies such as bioinformatics, haplotype mapping, proteomics, pharmacogenomics, and nanotechnology. Intellectual Property and Biotechnology will be of prime interest to lawyers and patent attorneys, scientists and researchers, business managers and technology transfer specialists..

Igniting Justice and Progressive Power - David B. Reynolds,Louise Simmons Preview:

A progressive resurgence is happening across the United States. This book shows how long-lasting coalitions have built progressive power from the regional level on up. Anchored by the "think and act" affiliate organizations of the Partnership for Working Families (PWF) these regional power building projects are putting in place the vision, policy agenda, political savvy, and grassroots mobilization needed for progressive governance. Through six sections, the book explores how Partnership for Working Families projects are a core part of the defeat of the right-wing in states such as California; the challenge to corporate neoliberalism in traditionally "liberal" areas; and contests for power in such formally solid red states as Arizona, Georgia, and Colorado. This book considers how these PWF groups work on economic, racial and environmental justice challenges, equitable development, and other critical issues. It addresses how, at their core, they bring together labor, community, environmental, and faith-based organizations and the coalitions and campaigns that they developed have won and continue to win substantial victories for their communities. Igniting Justice and Progressive Power will be of interest to activists and concerned citizens looking to understand how lasting political change actually happens as well as all scholars and students of social work, urban geography, political sociology, community development, social movements and political science more broadly..

Women and Entrepreneurship in India - Harpreet Kaur Preview:

The Indian Constitution is the largest written constitution that guarantees equality to women and empowers the State to take affirmative actions in favour of women. India has adopted International conventions for protection of rights of women and granting them equality and ratified the Convention on Elimination of All Forms of Discrimination Against Women (CEDAW) in the year 1993. The National Policy for Women Empowerment was presented in 2001, the goal of that policy to bring about the advancement, development and empowerment of women and enable women to become financially independent. Currently, India is the only country where the economic gender gap is larger than the political gender gap. Women are required to understand their own potential and overcome social barriers. With constant support of the government, change in stereotype mindset and skill development in women, India will continue witnessing gradual increase in women entrepreneurship in future. The aim of this book is to show the latest state of knowledge on the topic of women entrepreneurship, the role of women in business and women empowerment in India. Many aspects relating to role of women in business, sustainable business development and aspects going beyond economic empowerment of women are discussed in addition to presenting legal and regulatory frameworks. This book will be of interest to researchers, academics, policymakers, and students in the fields of entrepreneurship, empowerment, gender studies, and law..

The Interplay Between Competition Law and Intellectual Property - Gabriella Muscolo,Marina Tavassi Preview:

Although competition law and intellectual property are often interwoven, until this book there has been little guidance on how they work together in practice. As the intersection between the two fields continues to grow worldwide, both in case law and in regulation, the book's markets-based approach, focusing on sectors such as pharmaceuticals, IT, telecoms, energy and agriculture in eleven of the world's most active jurisdictions, provides a much-needed in-depth understanding of how this interplay reveals itself among the different legal systems. Written by a range of authors including judges, regulators, academics, economists and practitioners in both fields, the book provides an international comparative perspective as well as detailed analysis of specific cases, policies and proposals for change. Among the issues and topics covered are the following: – free movement of goods and the protection of intellectual property rights; – standard essential patents & injunction in patent cases; – intellectual property rights between technological development and consumer protection; – geo-blocking; – online platforms and antitrust; – excessive prices. In this context, special attention is paid throughout to the increasing dialogue among Competition Authorities and between Judges and Competition Authorities around the world. As matchless remedy for the lack of uniformity heretofore, the book's investigation of the nexus between competition law and intellectual property in different sectors and in various countries takes a giant step towards a more-balanced approach and more-levelled regulation and practices. It will be warmly appreciated by policy makers, decision makers, regulators, practitioners and academics in both competition law and intellectual property fields.

International Bankruptcy - Jodie Adams Kirshner Preview:

With the growth of international business and the rise of companies with subsidiaries around the world, the question of where a company should file bankruptcy proceedings has become increasingly complicated. Today, most businesses are likely to have international trading partners, or to operate and hold assets in more than one country. To execute a corporate restructuring or liquidation under several different insolvency regimes at once is an enormous and expensive challenge. With International Bankruptcy, Jodie Adams Kirshner explores the issues involved in determining which courts should have jurisdiction and which laws should apply in addressing problems within. Kirshner brings together theory with the discussion of specific cases and legal developments to explore this developing area of law. Looking at the key issues that arise in cross-border proceedings, International Bankruptcy offers a guide to this legal environment. In addition, she explores how globalization has encouraged the creation of new legal practices that bypass national legal systems, such as the European Insolvency Framework and the Model Law on Cross-Border Insolvency of the United Nations Commission on International Trade Law. The traditional comparative law framework misses the nuances of these dynamics. Ultimately, Kirshner draws both positive and negative lessons about regulatory coordination in the hope of finding cleaner and more productive paths to wind down or rehabilitate failing international companies..

A Future for Planning - Michael Harris Preview:

As well as being spatial, planning is necessarily also about the future – and yet time has been relatively neglected in the academic, practice and policy literature on planning. Time, in particular the need for longer-term thinking, is critical to responding effectively to a range of pressing societal challenges from climate change to an ageing population, poor urban health to sustainable economic development. This makes the relative neglect of time not only a matter of theoretical importance but also increasing practical and political significance. A Future for Planning is an accessible, wide-ranging book that considers how planning practice and policy have been constrained by short-termism, as well as by a familiar lack of spatial thinking in policy, in response to major social, economic and environmental challenges. It suggests that failures in planning often represent failures to anticipate and shape the future which go well beyond planning systems and practices; rather our failure to plan for the longer-term relates to wider issues in policy-making and governance. This book traces the rise and fall of long-term planning over the past 80 years or so, but also sets out how planning can take responsibility for twenty-first century challenges. It provides examples of successes and failures of longer-term planning from around the world. In short, the book argues that we need to put time back into planning, and develop forms of planning which serve to promote the sustainability and wellbeing of future generations..

It’s a dreamy, indomitable life worth reading about as today’s tennis tries to return to form.”—The Washington Post “An intriguing book about a fascinating woman…highly recommended.”—Library Journal (starred review) “Delightful and engrossing, this is a must for tennis fans.”—Publishers Weekly The story of 1930s tennis icon Alice Marble, and her life of sports, celebrity, and incredible mystery. Who was Alice Marble? In her public life, she was the biggest tennis star of the pre-war era, a household name like Joe DiMaggio and Joe Louis. She was famous for overcoming serious illness to win the biggest tournaments, including Wimbledon. She was also a fashion designer and trendsetter, a contributor to a pioneering new comic called Wonder Woman—and friend to the biggest names in Hollywood and society, like Carole Lombard and Clark Gable, William Randolph Hearst and Marion Davies, and members of families named Bloomingdale, Loew, and du Pont. She helped integrate tennis with her support of Althea Gibson, and even coached two young women who became stars in their own right: Billie Jean King and Sally Ride. Yet her private life provoked constant speculation while she was alive, and her own memoirs added layers of legend upon stories. According to Alice, she married a man who was killed in the skies over Europe during World War II. But who was the man she loved, and had he even existed? She was widely known for her patriotism during World War II. Had she really nearly given her life for her country as a spy, shot during a wild car chase fleeing foreign espionage agents? In The Divine Miss Marble, bestselling author Robert Weintraub traveled the country to uncover her fascinating story. And the more he learned about her, the more her mysteries and contradictions deepened. Alice was a powerful woman who knew her worth, demanding equal pay to men decades earlier than other female athletes; yet she was held in sway by a domineering, highly successful coach with whom she had a volatile relationship. She was renowned for her California style, and had a brilliant mind and the guts to overcome a lifetime of physical trauma. For the first time here, we come closer than ever before to the truths of this unforgettable life, and somehow it’s a story even more extraordinary than everything we already know about the divine Alice Marble..

Nature-Based Solutions to 21st Century Challenges - Robert C. Brears Preview:

This book provides a systematic review of nature-based solutions and their potential to address current environmental challenges. In the 21st century, society is faced by rapid urbanisation and population growth, degradation and loss of natural capital and associated ecosystem services, an increase in natural disaster risks, and climate change. With growing recognition of the need to work with ecosystems to resolve these issues there is now a move towards nature-based solutions, which involve utilising nature’s ecosystem to solve societal challenges while providing multiple co-benefits. This book systematically reviews nature-based solutions from a public policy angle, assessing policy developments which encourage the implementation of nature-based solutions to address societal challenges while simultaneously providing human well-being and biodiversity benefits. This includes enhancing sustainable urbanisation, restoring degraded ecosystems, mitigating and adapting to climate change, and reducing risks from natural disasters. While nature-based solutions can be applied strategically and equitably to help societies address a variety of climatic and non-climatic challenges, there is still a lack of understanding on how best to implement them. The book concludes by providing a best practice guide for those aiming to turn societal challenges into opportunities. This book will be of great interest to policymakers, practitioners and researchers involved in nature-based solutions, sustainable urban planning, environmental management, and sustainable development generally..

The author’s take is not a “how to do” book but rather one on “how to think.” Their basic premise is that too many boards are underperforming because they adopt or continue ineffective practices. However, thinking in more intentional if not new ways about not only what they do as boards, but how they go about their efforts, will help boards add value to the institutions and state systems they govern. The authors use thought provoking-titles and a conversational tone to engage the readers, get them to reflect on their work, and broaden their horizons..

Longlisted for the 2020 Andrew Carnegie Medals for Excellence This blazingly intimate biography of Janis Joplin establishes the Queen of Rock & Roll as the rule-breaking musical trailblazer and complicated, gender-bending rebel she was. Janis Joplin’s first transgressive act was to be a white girl who gained an early sense of the power of the blues, music you could only find on obscure records and in roadhouses along the Texas and Louisiana Gulf Coast. But even before that, she stood out in her conservative oil town. She was a tomboy who was also intellectually curious and artistic. By the time she reached high school, she had drawn the scorn of her peers for her embrace of the Beats and her racially progressive views. Her parents doted on her in many ways, but were ultimately put off by her repeated acts of defiance. Janis Joplin has passed into legend as a brash, impassioned soul doomed by the pain that produced one of the most extraordinary voices in rock history. But in these pages, Holly George-Warren provides a revelatory and deeply satisfying portrait of a woman who wasn’t all about suffering. Janis was a perfectionist: a passionate, erudite musician who was born with talent but also worked exceptionally hard to develop it. She was a woman who pushed the boundaries of gender and sexuality long before it was socially acceptable. She was a sensitive seeker who wanted to marry and settle down—but couldn’t, or wouldn’t. She was a Texan who yearned to flee Texas but could never quite get away—even after becoming a countercultural icon in San Francisco. Written by one of the most highly regarded chroniclers of American music history, and based on unprecedented access to Janis Joplin’s family, friends, band mates, archives, and long-lost interviews, Janis is a complex, rewarding portrait of a remarkable artist finally getting her due..

Competing for the Internet - Flip Petillion,Jan Janssen Preview:

The Internet Corporation for Assigned Names and Numbers (ICANN), founded in 1998, is a not-for-profit public-benefit corporation established to ensure a stable and secure global Internet. As the custodian of the Domain Name System (DNS), one of its key responsibilities is the introduction and promotion of competition in Internet-related markets, an aim which ICANN has tried to achieve through the delegation of generic top-level domains (gTLDs). This book investigates how successful ICANN has been in achieving this goal. Over the years, ICANN has been required to decide on a substantial number of complaints from applicants for gTLDs related to capture, arbitrariness, discrimination, and unwarranted restriction of competition. This book is the first detailed study of complaints related to ICANN decisions that have been brought using ICANN's Independent Review Process (IRP). The authors - preeminent expert practitioners in international litigation and arbitration related to Internet governance - take a close look at how ICANN has handled the major issues raised and how ICANN has shaped its own accountability mechanisms. The book also weighs the influence of external accountability on ICANN’s decision-making process and considers the implications of third-party decisions (such as IRP decisions) for the ongoing development of the Internet. This authoritative analysis covers: • the regulatory framework governing ICANN and the introduction of new gTLDs in a historic perspective; • ICANN’s accountability framework; • all the IRP cases that have been decided to date, with an in-depth analysis of those cases that have become reference decisions in the latest application round; and • the 2016 amendments to ICANN’s articles of incorporation and bylaws, concentrating on the problems that remain unresolved. This work is a welcome addition to the debate on how to address the shortcomings in ICANN’s accountability in the interests of the global Internet community. The authors make concrete proposals and recommendations, suggesting changes to ICANN’s regulatory framework in the light of the lessons learned and with a view to preventing similar problems arising in a next round of gTLD applications. This book has the potential to become the Green Book for fundamental changes to ICANN’s accountability framework..

With a fine-tuned ethnographic sensibility, Janis H. Jenkins explores the lived experience of psychosis, trauma, and depression among people of diverse cultural orientations, revealing how mental illness engages fundamental human processes of self, desire, gender, identity, attachment, and interpretation. Extraordinary Conditions illuminates the cultural shaping of extreme psychological suffering and the social rendering of the mentally ill as nonhuman or not fully human. Jenkins contends that mental illness is better characterized in terms of struggle than symptoms and that culture is central to all aspects of mental illness from onset to recovery. Her analysis refashions the boundaries between the ordinary and the extraordinary, the routine and the extreme, and the healthy and the pathological. This book asserts that the study of mental illness is indispensable to the anthropological understanding of culture and experience, and reciprocally that understanding culture and experience is critical to the study of mental illness..

Janis Joplin was the skyrocket chick of the sixties, the woman who broke into the boys' club of rock and out of the stifling good-girl femininity of postwar America. With her incredible wall-of-sound vocals, Joplin was the voice of a generation, and when she OD'd on heroin in October 1970, a generation's dreams crashed and burned with her. Alice Echols pushes past the legary Joplin-the red-hot mama of her own invention-as well as the familiar portrait of the screwed-up star victimized by the era she symbolized, to examine the roots of Joplin's muscianship and explore a generation's experiment with high-risk living and the terrible price it exacted. A deeply affecting biography of one of America's most brilliant and tormented stars, Scars of Sweet Paradise is also a vivid and incisive cultural history of an era that changed the world for us all..

"Snacks" is a history of Canadian snack foods, of the independent producers and workers who make them, and of the consumers who can’t put them down. Janis Thiessen profiles several iconic Canadian snack food companies, including Old Dutch Potato Chips, Hawkins Cheezies, and chocolate maker Ganong. These companies have developed in distinctive ways, reflecting the unique stories of their founders and their intense connection to specific locations. These stories of salty or sweet confections also reveal a history that is at odds with popular notions of “junk food.” Through extensive oral history and archival research, Thiessen uncovers the roots of our deep loyalties to different snack foods, what it means to be an independent snack food producer, and the often-quirky ways snacks have been created and marketed. Clearly written, extensively illustrated, and lavish with detail about some of Canadians’ favorite snacks, this is a lively and entertaining look at food and labour history..

This book offers practical advice on managing enterprise modeling (EM) projects and facilitating participatory EM sessions. Modeling activities often involve groups of people, and models are created in a participatory way. Ensuring that this is done efficiently requires dedicated individuals who know how to organize modeling projects and sessions, how to manage discussions during these sessions, and what aspects influence the success and efficiency of modeling in practice. The book also includes a summary of the theoretical background to EM, although participatory modeling can also be used in conjunction with other methods that are not made for EM, such as those made for goal-oriented requirements engineering and information systems analysis. The first four chapters present an overview of enterprise modeling from various viewpoints (including methods, processes and organizational challenges), providing a background for those that need to refresh their basic knowledge. The next six chapters form the core of the book and detail the roles and competences needed in an EM project, typical stakeholder behaviors and how to handle them, tools and methods for managing participatory modeling and facilitation, and how to train modeling experts for these social aspects of modeling. Lastly, a concluding chapter presents a summary and an outlook on current research in participatory EM. This book is intended for anybody who wants to learn more about how to facilitate participatory modeling in practice and how to set up and carry out EM projects. It does not require any in-depth knowledge about specific EM methods and tools, and can be used by students and lecturers for courses on participatory modeling, and by practitioners wanting to extend their knowledge of social and organizational topics to become an experienced facilitator and EM project manager..

Sherry Arnstein, writing in 1969 about citizen involvement in planning processes in the United States, described a “ladder of citizen participation” that showed participation ranging from low to high. Arnstein depicted the failings of typical participation processes at the time and characterized aspirations toward engagement that have now been elevated to core values in planning practice. But since that time, the political, economic, and social context has evolved greatly, and planners, organizers, and residents have been involved in planning and community development practice in ways previously unforeseen. Learning from Arnstein’s Ladder draws on contemporary theory, expertise, empirical analysis, and practical applications in what is now more commonly termed public engagement in planning to examine the enduring impacts of Arnstein’s work and the pervasive challenges that planners face in advancing meaningful public engagement. This book presents research from throughout the world, including Australia, Brazil, India, Indonesia, Portugal, Serbia, and the United States, among others, that utilizes, critiques, revises, and expands upon Arnstein’s aspirational vision. It is essential reading for educators and students of planning..

This book analyses core-periphery relations to highlight the growing cleavage, and potential conflict, between the core and peripheral member-states of the Union in the face of the devastating consequences of Eurozone crisis. Taking a comparative and theoretical approach and using a variety of case studies, it examines how the crisis has both exacerbated tensions in centre-periphery relations within and outside the Eurozone, and how the European Union’s economic and political status is declining globally. Justice Perverted - Charles Patrick Ewing Preview:

Over the past quarter century Congress, state legislatures and the courts have radically reshaped America's laws dealing with sex offenders in an effort to reduce the prevalence of sex offenses. Most convicted sex offenders must now register with the authorities, who then make information about them available to the public. Possession of child pornography has been made an extremely serious crime often punishable by prison sentences that dwarf those meted out to child molesters, rapists, robbers, and even killers. Federal law now imposes a minimum sentence of ten years in prison for those convicted of using the internet to attempt to lure minors for sex. And the federal government and 20 states have "sexually violent predator" laws that allow the indefinite civil commitment of convicted sex offenders to secure institutions for treatment after they have served their full criminal sentences. All of these changes in sex offender law, as well as numerous others, have been based at least in part on input from psychology, psychiatry and the social sciences. Moreover, enforcement and administration of many of these laws relies to a large extent on the efforts of mental health professionals. However, many questions about this involvement remain largely unanswered. Are these laws supported by empirical evidence, or even by well-reasoned psychological theories? Do these laws actually work? Are mental health professionals capable of reliably determining an offender's future behavior, and how best to manage it? Finally, are experts capable of providing effective treatment for sex offenders -- i.e., treatment that actually reduces the likelihood that an identified sex offender will re-offend? In Justice Perverted, Charles Patrick Ewing poses these difficult questions and others that few in either law or psychology have asked, much less tried to answer. Drawing on research from across the social and behavioral sciences, he weighs the evidence for the spectrum of sex offense laws, to occasionally surprising results. A rational look at an intensely emotional subject, Justice Perverted is an essential book for anyone interested in the science behind public practice..

Our economy, our politics, our culture, and even the shape of our family life are being transformed. But who are these wired young people? And what is the world they're creating going to look like? Enterprise modeling (EM) methods and techniques are indispensable for understanding the present situation of an enterprise and for preparing for its future – particularly in times of continuous organizational change, an increasing pace of innovation, new market challenges or technology advances. The authors combine a detailed description of the 4EM methodology with their concrete experience gathered in projects. Their book addresses the modeling procedure, modeling language and modeling practices in a uniquely integrated approach. It provides practical advice on common challenges faced by enterprises and offers a flexible EM method suitable for tackling those challenges. Much of the work presented stems from actual research projects and has been validated with scientific methods. The 4EM methodology has proven its practical value in a large number of successful development and/or change management projects in industry and the public sector. The book was written for anyone who wants to learn more about EM, with a specific focus on how to do it in practice and/or how to teach it. Its main target audience thus includes instructors in the field of EM or business information systems, students in Information Systems or Business Administration, and practitioners working in enterprise or change management. The authors describe a clear reading path for each of these audiences and complement the work with a set of slides and further teaching material available under
